Vera Greene (plaintiff), as the designated beneficiary of her deceased husband, Donald Greene, brought this action against the Public Employees Retirement Association (PERA) to recover her husbands accumulated deductions, pursuant to section 24-51-117(1), C.R.S. 1973. Trial to the court resulted in a judgment for the plaintiff. The court of appeals affirmed in Greene v. Public Employees Retirement Assn, 39 Colo. App. 468, 570 P.2d 24 (1977). We reverse for remand with directions to enter judgment for the defendant.
